CHAPTER 7

ANIMALS AND FOWL

Article 1.  In General

Article 2. Dogs

7-201               Dogs

Article 1.  In General

Section 7-101.  Fast or Immoderate Driving of Animals

It shall be unlawful for any person to be engaged in fast or immoderate riding or driving of animals through or on the streets and avenues of the Town, or to engage in racing or speeding a horse or other animal faster than a gait of six miles an hour.

Section 7-102.  Raising and Selling of Poultry

No owner, lessee or tenant shall erect or maintain any building, coop or pen upon any property in the Town within two hundred feet of the property of adjoining owners of property in the Town for the purpose of raising, fattening, maintaining or selling any poultry or the eggs produced therefrom.

No owner, lessee or tenant of any property in the Town shall have on their premises any poultry for sale or for any other commercial purpose whatsoever, within two hundred feet of the property of adjoining owners of property in the Town.

Section 7-103.  Permit Required for Keeping Swine

It shall not be lawful for any person to keep swine within the Town without having obtained from the Commissioners a permit to do so.

Section 7-104.  Inspection of Premises for Keeping Swine

The Commissioners shall, before granting a permit to any person applying for the same, direct the Chief of Police to examine the premises and the proposed location of the pen or enclosure.  After the examination or inspection, the Chief of Police shall report all the facts to the Commissioners, and if they determine that the location does not interfere with the health of the community or otherwise prove offensive to the immediate neighborhood, it shall be their duty to grant a permit for the period of one year.

Section 7-105.  Revocation of Permit Required for Keeping Swine

The Commissioners, upon complaint, may, in their discretion, order the removal of any pigpen and revoke any permit granted for the keeping of swine.

Section 7-106.  Animals Running at Large

It shall be unlawful for swine, horses, mules, goats, milk cows, cattle, sheep and geese to go at large on the streets, alleys or avenues of the Town.

Section 7-107.  Impoundment and Sale of Animals

The Chief of Police shall take up and impound any swine, horse, mule, cattle, sheep, goats and geese found running at large and on his failure to take up and impound any swine, horses, mules, goats, sheep, geese or cattle, as aforesaid, it shall, and may be lawful for any citizen of the Town to do so.  Any person so taking up and impounding anything prohibited from going at large, shall give five days notice thereof, by advertisement set up at a designated place within the courthouse and two other conspicuous places in the Town, describing the stock so impounded, and that the same will be sold at public sale, at some public place in the Town.  The owner of any stock so impounded shall pay twenty-five dollars for taking up each of such stock, except geese which shall be five dollars each and all expenses of keeping and advertising the same, and the Chief of Police shall deliver the property to the owner or his agent.

Section 7-108.  Disposition of Proceeds of Sale

In case of a sale of any stock impounded under this Article, the money arising therefrom shall go to pay all costs and expenses, including the poundage fee for taking up each of the stock so impounded, and the balance, if any, to the owner of the stock.

Section 7-109.  Penalty

Any violation of any of the provisions of the ordinances listed in this Article 1, Chapter 7 shall be a municipal infraction and a violator shall be fined fifty ($50.00) for a first offense and two hundred dollars ($200.00) for each subsequent offense.  A separate offense shall be deemed committed on each day or fraction of a day in which or during which a violation occurs or continues.

 

Article 2.  Dogs

Section 7-201.  Dogs

Dogs within the Town are hereby regulated under the provisions of Harford County Code, Chapter 64, entitled "Animals", and shall be enforced within the Town in the same manner by the same officials and with the same effect as in unincorporated areas of Harford County and all persons within the Town shall be required to abide by said provisions and to pay required licensing fees to Harford County in the manner provided in said ordinance
